What the labour law requires on a payslip

Section 12A(5) of the Labour Act [Chapter 28:01] says all remuneration must be accompanied by a written statement. In practice that means the payslip goes to the employee with the pay, not afterwards. The statement must show: the names of the employer and the employee; the amount of remuneration and the period it covers; the part of the remuneration that is a bonus or allowance; any deductions; and the net amount the employee receives.

Section 12A also limits what you may take off. Pay must be in legal tender (subsection 1) and paid to the employee directly (subsection 4). Deductions are allowed only for unpaid absence, amounts the employer must pay by law, a recovery of advances that does not exceed 25% of gross pay owed, and written stop-orders such as insurance, pension, medical aid and burial society contributions (subsection 6). Your payslip should list each of these separately so the employee can see which applies. This was read in the version of the Act updated to 2019.
