When a quote or proforma has legal weight

Quotations carry legal weight mainly in public buying. The Public Procurement Regulations 2020 (Legal Notice No. 324 of 2020, made under the Public Procurement Act 2011 and published by the Eswatini Public Procurement Regulatory Agency, ESPPRA) let a government buyer use a request for quotations only below E20,000 for goods and non-consultancy services and below E50,000 for works (regulation 41 and Part II of the First Schedule). Above those figures the buyer must use limited or open tendering, and below E2,000 (E5,000 for works) it may buy from a single source.

When you are asked to quote to a public body, the written quotation is requested from a shortlist the controlling officer has authorised, normally no more than four suppliers (regulation 96). Negotiation is not allowed (regulation 94(3)): the quotation with the lowest evaluated price that meets the requirements is recommended for award (regulation 95(3)). Price it as final.

Under the Competition Act 2007, the definition of a sale in section 2 includes furnishing a quotation, verbally or in writing. That brings quotes within section 30(5), which prohibits rival businesses from fixing prices or rigging bids between themselves, so quotes should never be agreed with a competitor.
