Price rules that affect your markup

The limits on pricing come from the Fair Trading Act (in force since 5 November 2001) and the Competition Act 2007, both enforced by the Eswatini Competition Commission. Neither sets a price cap or a mandated margin.

Section 7(g) of the Fair Trading Act bars any false or misleading representation about the price of goods or services. Section 13 bars bait advertising: if you advertise a specified price you must actually offer the goods or services at that price, for a reasonable period and in reasonable quantities. A breach of Part II is an offence under section 21, with a fine of up to E100,000, up to five years in prison, or both.

On the competition side, section 31(f) of the Competition Act lists resale price maintenance among prohibited practices, meaning a supplier cannot fix the minimum or maximum price at which you resell. Section 33(1)(d) also prohibits conduct likely to mislead the public about price.
