When a quote or proforma has legal weight
Seychelles law gives a quotation weight mainly in public buying. Under section 64 of the Public Procurement Act 2008, a public body may use a request for sealed quotations only for readily available standard goods, small works or other small services. The request is made in writing to at least three bidders, unless fewer than three suppliers can supply the item, and it states the quality, quantity, terms and time of delivery.
Each bidder may submit one sealed quotation, and it cannot be altered or negotiated afterwards. A quote sent to a public body should therefore be priced and dated as a firm offer, with delivery terms stated, because the buyer cannot reopen it.
Since the Public Procurement (Amendment) Act 2022 (Act 33 of 2022, gazetted 30 December 2022), a public body can also use simplified bidding (new section 60A) for readily available standard goods such as stationery, consumables and office equipment, under a procedure set by regulations. Approval of the purchase depends on its size under Schedule 1: up to SCR 250,000 for goods, services and works the Accounting Officer approves; from SCR 250,000 to SCR 850,000 the Procurement Committee approves; above SCR 850,000 the National Tender Board approves. For consultancy the limits are SCR 75,000 and SCR 250,000.
