The rules in Malaysia
- Overtime starts after 45 hours a week.
- Overtime starts after 8 hours a day.
- Limit: 104 hours a month.
- The rate applies to your normal gross hourly pay.
- Set by Employment Act 1955 ss. 60, 60A, 60D.
Worth knowing
The pay rates stop applying above RM4,000 a month, except for manual workers under paragraph 2 of the First Schedule. The hours limits apply to everyone. Peninsular Malaysia and Labuan only.
Questions people ask
- Is this the amount I am owed?
- It is what the statutory rate produces for the hours you entered. Your contract or a collective agreement may give you more, and in many countries usually does. The statutory figure is a floor, not a ceiling.
- Which pay do I put in the hourly box?
- The pay one ordinary hour earns, on the base this country uses. That is not always gross pay: several countries apply the multiplier to basic wage only, so allowances are left out. The box above says which one applies here.
- Does the rate change on a rest day or a public holiday?
- In most countries yes, and often by a lot. Choose the kind of day above and the rate changes with it. Where a country sets no separate rate, the page says so rather than guessing one.
- Do the premiums stack on top of each other?
- It depends on the country, and this is where people go wrong. The Philippines multiplies them, so overtime on a public holiday is 260%, not 225%. Colombia says expressly that surcharges apply on their own and never accumulate. Read the note for your country.
- Can my employer make me work overtime?
- Usually only within the limits shown above, and in some countries only with your written consent. The caps are legal limits on hours, not targets. Exceeding them is a breach even where the extra hours are paid correctly.
