When a quote or proforma has legal weight
Jamaican law attaches few formalities to an ordinary quotation, but three situations give a written estimate legal weight.
Repairs: under section 27 of the Consumer Protection Act, a business that repairs goods for consumers must keep a record that includes the consumer's contact details, a description of the item, the agreed replacement value, an estimate of the labour and other costs, the date received and the date it will be ready. A copy must go to the consumer before the repair begins. Breaking this rule is an offence with a fine of up to $500,000. Section 26 adds that a provider may not make a consumer sign an open-ended commitment to pay for extra work.
Government work: a supplier tendering for a public contract above the competition thresholds must first be registered with the Public Procurement Commission. The Commission lists those thresholds as Ja$3,000,000 for goods and general services and Ja$5,000,000 for works, with consultancy excepted.
