When a quote or proforma has legal weight
German law gives a quote no special form and no tax status. A Kostenanschlag, the written estimate for work, matters under section 649 BGB: if the contract was based on an estimate for which the contractor did not guarantee the figure, and the work cannot be done without a substantial overrun, the customer may cancel and the contractor can claim only payment for work already done and expenses (section 645(1) BGB).
If an overrun of that kind is to be expected, the contractor must tell the customer without delay (section 649(2) BGB). A quote that says it is a binding fixed price therefore carries more weight than one marked as an estimate, so say which it is.
