When a quote or proforma has legal weight
No published law gives private quotations or proforma invoices a special form. Quotations carry legal weight mainly in government purchasing, under Decree No. 37 of 2002, the Implementing Regulations of the Law Regulating Government Tenders and Purchases (Legislative Decree No. 36 of 2002).
In a tender, all prices must be written in Bahraini dinars in words and figures unless the tender documents say otherwise (Article 42). Strike-throughs and erasures are not permitted in bills of quantities and quotations: a correction is rewritten in words and figures and signed by the bidder.
A direct purchase, made with the approval of the Tender Board, starts with a requisition asking a supplier or contractor for a proposal or quotation, and the authority may not hint that competition is lacking (Article 61). The quotations must be enclosed with the transaction file to show that the price is in line with the market (Article 60), and where the supply needs a warranty 10% of the supplier's dues is retained until the warranty period ends.
