When a quote or proforma has legal weight
Oman has no general rule that a quotation is binding, but consumer law gives a price the supplier states to a consumer real force. The consumer has the right to receive a service at the advertised price (Consumer Protection Law, Royal Decree 66/2014, Art. 14), and the supplier may not charge more than that price (Art. 28).
A quote to a consumer should therefore fix the price. The Executive Regulations treat as void any term that lets the price be set on delivery or revised unilaterally by the supplier, and any term requiring the consumer to pay the full price before receiving the product or service when delivery is not immediate (Art. 20, items 5 and 11). These terms are void even when they appear in a contract template, a document, an invoice or a notice.
Once the job is accepted, the supplier must issue an invoice in Arabic, whether or not the consumer asks, showing the supplier's name, trade name and commercial registration number, the date of the contract, the price and any taxes, the quantity, the delivery date and method of execution, the signature and seal, and any warranty or maintenance period (Art. 12). A quote that already carries these details, in Arabic, converts easily into that invoice. A seller of a used or defective item must say so in the contract or invoice (Law, Art. 29).
