When a quote or proforma has legal weight
A quotation carries legal weight under the Consumer Protection Act defines "offer for sale" to include furnishing a quotation, verbally or in writing, and its definition of "sale" includes an offer for sale.
When the customer is a consumer, the price rules in section 37 apply: the price is stated in local currency and includes every duty, tax, charge, fee or levy the consumer will pay. Section 38 requires the particulars to be in an official language and in legal tender and recognised measuring units. For a service, section 36(3) expects the parts, accessories, their price, the labour cost and the terms of supply to be shown, so a quote for repair or installation work should itemise them. Breaching these duties is an offence with a fine of K500,000 and imprisonment for five years.
