When a quote or proforma has legal weight
Stamp duty falls on the contracts, transfer documents and account books listed in the Schedule to the Stamp Duty Law (Article 2) and arises on the day the instrument is written (Article 15). The base is the contract amount excluding VAT that is stated separately (Article 5). Duty is declared quarterly, yearly or per instrument (Article 16), and an individual's electronic order with an e-commerce operator is exempt (Article 12).
In public procurement, the request-for-quotation method (询价) is allowed only for goods or services with uniform specifications and standards, plentiful stock and little price movement (Government Procurement Law, Article 32). Other methods are open tender, invited tender, competitive negotiation and single-source purchasing (Article 26).
A consumer service that is paid after use must be accompanied by a settlement list issued before payment, naming each service, its price and the total (Provisions on Clearly Marked Prices, Article 15).
