The rules in China
- Overtime starts after 40 hours a week.
- Overtime starts after 8 hours a day.
- Limit: 36 hours a month.
- The rate applies to your normal gross hourly pay.
- Set by Labour Law of the PRC 1994 arts. 36, 41, 44.
Worth knowing
Rest-day work can be answered with compensatory rest instead of pay; holiday work cannot. Employees on non-fixed hours receive no overtime pay at all.
