Price rules that affect your markup

Most prices are set by the seller (Price Law, Article 6). The government may set a guide price or fixed price only for a few goods and services of major importance to the economy and daily life, scarce resources, natural monopolies, major public utilities and major public-benefit services; the central and local pricing catalogues decide the scope (Articles 18 and 19).

Sellers must mark prices clearly (Price Law, Article 13). Under SAMR's Provisions on Clearly Marked Prices (Order No. 56, in force 1 July 2022) a seller must show the name, price and pricing unit of goods or the service item and price, may not charge more than the marked price or any unmarked fee (Article 8), and generally shows the price in RMB in Arabic numerals with other price information in standard Chinese characters (Article 9).

A compared-to price must be real: if a seller does not give the details, it cannot be higher than the lowest transaction price at that place in the previous seven days (Article 16), and a price cannot be raised temporarily before a discount (Article 17). Online, the price on the home page cannot be lower than on the detail page (Article 20). County-level market regulators enforce the rules (Article 22).
