When a quote or proforma has legal weight

No federal law gives a quote or proforma invoice legal weight in Canada, but provincial consumer law does for estimates given to consumers. In Ontario, when a contract with a consumer includes an estimate, the business cannot bill more than 10% above the estimated price unless the consumer agrees to the extra charges in writing (Consumer Protection Act, 2002, as explained in the Ministry's Business Guide to Consumer Protection). If the job changes in a major way, issue a revised written estimate and have the customer sign off on it.

In Quebec, a vehicle repair shop must give a written evaluation when the repair will cost more than $100. It must show the names and addresses of the consumer and the garage, the make, model and licence plate, a description of the repair, the total price, whether parts are new, used, remanufactured or refurbished, the date and how long the evaluation is valid. The garage cannot charge more than the total in the evaluation; it can add only the cost of extra repairs the consumer has authorized. The evaluation is free unless the garage states the exact fee before preparing it. A waiver printed by the merchant has no legal value: the consumer must write and sign the refusal themselves (Office de la protection du consommateur, under the Consumer Protection Act, CQLR c. P-40.1).
