When a quote or proforma has legal weight
Repair and maintenance quotes are regulated by section 15 of the Consumer Protection Act 68 of 2008. Where it applies, because you take the item in or the consumer asks for an estimate, you may not charge until you have given an estimate and the consumer has authorised the work, or the consumer has declined an estimate or pre-authorised a maximum in writing. The estimate itself is free, including diagnosis, stripping and reassembly, unless you disclosed its price and the consumer agreed. You may not exceed the estimate unless you report the extra charges and the consumer approves them.
For VAT, the signed contract counts, not the quote. A written contract that will take your taxable supplies over the compulsory threshold within 12 months makes registration compulsory from that point. SARS accepts a written tender award or signed contract as proof of supplies, but not tender proposals before award, business plans or unfulfilled orders.
