When a quote or proforma has legal weight
A quotation from a GST-registered business must be tax-inclusive. Under section 54 of the GST Act, any price you advertise or quote for a taxable supply must include the GST payable, and the quotation must also show the GST amount separately. You may add a GST-exclusive figure only if the GST-inclusive price is shown with equal or greater prominence. The Commissioner-General can approve another display method for a class of taxpayers.
If you quote to a government body, the Public Procurement Act 2016 sets the rules. Sections 44 and 45 allow a request for quotations for lower-value purchases. Quotations are requested in writing from at least three bidders, each bidder gets one quotation that cannot be altered or negotiated, and the purchase order goes to the lowest-priced quotation that meets the requirements. The First Schedule fixed the ceiling in 2016 at Le60 million for goods and services and Le150 million for works, in old leones. Ask the procuring entity for the current threshold.
A proforma invoice does not clear goods. The Customs Act 2011 (section 11(5)) lists the mandatory customs clearing documents: the commercial invoice, packing list, classification and valuation certificate, bill of lading, delivery order and bank payment receipt, plus permits and health certificates where they apply.
