When a quote or proforma has legal weight
A proforma invoice is a defined document under the E-invoicing Regulations 2023 (reg 2). It has the characteristics of a normal invoice but is not proof of a transaction and does not affect turnover, and the platform issues no Invoice Registration Number for it. A quotation or proforma should not be labelled a VAT invoice, because only a registered person making a taxable supply may issue a document showing an amount as VAT (VAT Act s.20(5)).
Quotations carry formal weight in public procurement. Under section 20 of the Public Procurement Act 2006 a public body may use a request for sealed quotations only for readily available commercially standard goods, small works or small other services whose estimated value does not exceed the prescribed threshold. The request is made in writing to at least 3 bidders, unless the item is not available from 3 suppliers, and states quality, quantity, terms and time of delivery. Each bidder submits one sealed quotation, which cannot be altered or negotiated.
