Price rules that affect your markup
Price control rests on the Consumer Protection (Price and Supplies Control) Act 1998. The Minister may fix by regulations the price of goods listed in the First Schedule (s.3) and the maximum mark-up of goods listed in the Second Schedule (s.4). Selling controlled goods above the fixed price, or with a mark-up over the maximum, is an offence. A Code of Practice may set a maximum recommended retail price for other goods, and a trader who sells such goods must label a specimen with it (s.5).
Price display is mandatory (s.7). A VAT-registered seller of goods must label a specimen in a conspicuous place with the selling price and the words that the amount is inclusive of VAT, or that VAT is zero for zero-rated goods. For services the price must be made available before the service is supplied, with the same VAT indication. Exempt goods and services show the price and that VAT is nil. Failing to comply carries a fine of up to Rs 300,000 and imprisonment of up to 5 years.
A seller may not charge more than the labelled price (s.8), may not give a misleading price indication by any means (s.9) and may not charge VAT where none is chargeable or at a higher rate than the law allows (s.6).
