When a quote or proforma has legal weight

Central Government departments buy on the basis of quotations and bids. Under the General Financial Rules, 2017 (updated to 31 July 2025), Rule 149 makes buying on the Government e-Marketplace (GeM) mandatory for goods and services listed there. Up to Rs 50,000 a buyer may use any available GeM supplier that meets the specification. Above Rs 50,000 and up to Rs 10,00,000 the order goes to the GeM seller with the lowest price among at least three different manufacturers. Above Rs 10,00,000 the buyer must run online bidding or a reverse auction. These limits were raised by a Department of Expenditure order of 10 July 2024.

For an item that is not on GeM, a quotation matters by value. Rule 154 allows purchases up to Rs 50,000 on each occasion without quotations, on a certificate that the buyer is satisfied of quality, supplier reliability and a reasonable price. Rule 155 covers purchases above Rs 50,000 and up to Rs 5,00,000, made by a Purchase Committee of three members that surveys the market, so competing quotations are the normal evidence.

Larger purchases move to tenders. Rule 162 allows a Limited Tender Enquiry for goods up to Rs 50 lakh, sent to more than three registered suppliers, and Rule 161 requires an advertised tender on GeM and the Central Public Procurement Portal for goods of Rs 50 lakh and above. Unsolicited bids are not accepted, so a supplier must be registered or listed before a quote can be considered. Scientific ministries and research institutions have lower GeM limits (Rs 1,00,000 in place of Rs 50,000 for the first tier). State governments and public bodies follow their own procurement rules.
