When a quote or proforma has legal weight
Quotations carry formal weight mainly in public procurement. Under Department of Public Expenditure circular 05/2023 (28 March 2023), contracts under 5,000 euro excluding VAT can be awarded on verbal or written quotes from one or more suppliers.
Contracts between 5,000 euro and 50,000 euro excluding VAT may be awarded on written specifications sent to at least three suppliers, on at least three quotations through the eRFQ facility on eTenders, or through a formal tender advertised on eTenders. At 50,000 euro excluding VAT and above for goods and services, the contract must be advertised on eTenders.
A supplier tendering to a public body should therefore quote in euro excluding VAT, since every threshold is expressed that way.
