When a quote or proforma has legal weight
Gambian law gives written estimates legal weight mainly in repairs. Under the Consumer Protection Act 2014, section 8(5), a business that offers repair services must keep a record and give the customer a copy stating the customer's name, address and telephone number, a description of the goods, the agreed replacement value, an estimate of labour and other costs, and the dates the goods are received and ready.
If more repairs turn out to be needed, the repairer must tell the customer, and if the customer chooses not to have them done the repairer must obtain a written indemnity (section 8(6)).
For quotes sent by phone, email or online, section 10(1) requires the supplier to give the price including all taxes, delivery cost, payment and delivery arrangements, and the period for which the offer or price remains valid, before the contract is concluded.
