When a quote or proforma has legal weight

A quotation has formal legal weight in Nepal mainly in public buying. Under section 40 of the Public Procurement Act 2063, a public entity can buy goods, works or services by sealed quotation (sealed दरभाउपत्र) instead of full tendering, and the quotation form must state the specification, quality, quantity, supply terms and delivery time. Under rule 84(1) of the Public Procurement Regulation 2064, this route is open where the entity's cost estimate is up to NPR 20 lakh (NPR 2,000,000). For X-ray, ECG, medicines and diagnostic or treatment equipment the ceiling is NPR 50 lakh (rule 84(1A)). Above NPR 20 lakh, rule 31 requires an open bid.

The entity must publish a notice at least seven days before the closing date (section 40(3), as amended by the Public Procurement (Second Amendment) Ordinance 2083), unless the call goes out through the e-procurement system. The notice states where the form can be bought and its fee, any security required, where and how to send the quotation, and the closing and opening date and time (rule 84(3)). If fewer than three quotations arrive, or none, the notice is repeated once (rule 84(3A)).

Once a sealed quotation is submitted it cannot be returned or amended (section 40(4)). A supplier should therefore price the full specification, delivery terms and validity period before submitting, and keep a copy of the quotation exactly as sent.
