When a quote or proforma has legal weight

A Dutch quote (offerte) is an offer under art. 6:219 BW. It can be withdrawn unless it states a period for acceptance or its irrevocability follows in another way, and withdrawal is only possible until the offer is accepted or an acceptance has been sent. An offer marked as non-binding (vrijblijvend) can still be withdrawn without delay after acceptance.

For work contracted out (aanneming van werk), art. 7:752 BW limits what a price estimate allows. If the contract fixes only an indicative price (richtprijs), the customer owes a reasonable price, and the richtprijs may be exceeded by no more than 10% unless the contractor warned the customer in time about a likely further overrun. The same limit applies when the price depends on an estimated duration of the work.
