When a quote or proforma has legal weight
A quotation has no special status for ordinary sales, but a proforma invoice does in one VAT process. A person intending to have a fishing boat, marine engine, fishing net, line or other capital equipment supplied solely for commercial fishing may apply to the Minister responsible for marine exploitation for the tax to be waived, and the application must carry the original and one copy of a proforma invoice (VAT Act, section 46(2)).
That proforma invoice must meet every requirement for a tax invoice, including the rate of tax and the amount to be claimed from the customer, but must be clearly identified as a proforma invoice (section 46(3)). If the Minister issues a certificate of waiver naming that proforma invoice, the supplier may make the supply as if no tax were payable and it is treated as zero-rated (section 46(5)).
Both the proforma invoice a supplier gives and the certificate of waiver received must be kept with the business's VAT records (section 38(3)).
