When a quote or proforma has legal weight
The quotation rules with a legal text behind them apply when the buyer is a ministry or other government body, which buys under the Government Procurement Bylaw No. 28 of 2019. Under Article 26 the normal route is a tender, and the Bylaw allows limited tender, two-stage tender, a request for offers, single-source purchase or direct execution only for justified reasons.
For small purchases of goods that are readily available, Article 48 lets the buyer use a request for price quotations. The request goes out in writing to at least three bidders and states the quality, quantity, delivery terms and delivery date, with enough time to answer. A supplier quoting against it should therefore match each of those points line by line, because the buyer instructs the lowest-priced bidder whose offer meets the delivery and other requirements.
Limited tender, where the buyer invites bidders directly, is allowed by Article 44(e) when the value of supplies does not exceed JOD 5,000, and Article 45 requires offers from at least three bidders, with the notice published on the electronic procurement portal. Single-source purchase under Article 49 is allowed only in listed cases, such as a sole source with no suitable alternative, a second tender that produced no suitable offer, exclusive rights or spare parts for earlier supplies, or goods whose prices are fixed by the competent authority. Under Article 69 an official's own buying power is capped per purchase: JOD 5,000 for the Minister, JOD 1,000 for the Secretary General and JOD 200 for a directorate head, so a quotation above those figures is decided by a purchasing committee.
